A MEMORIAL

INSTRUCTING INTERESTED GROUPS TO DEVELOP A CONSENSUS BILL THAT IS ACCEPTABLE TO LANDOWNERS AND OIL AND GAS AND MINERAL PRODUCERS ADDRESSING SURFACE PROTECTIONS AND COMPENSATION METHODS.

 

     WHEREAS, the economy of the state of New Mexico depends heavily upon the economic viability of landowners and land values and the energy, minerals and oil and natural gas industries; and

     WHEREAS, there exists a conflict between the rights of surface owners and the rights of subsurface producers; and

     WHEREAS, legislating a method to resolve the conflict and improve protections is an undesirable but necessary solution; and

     WHEREAS, the associations, groups and individuals involved in the issue are capable and willing to reach and support an agreement on consensus language for legislation, and they agree that doing so is in their best interests;

     NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE OF NEW MEXICO that landowner representatives, the New Mexico cattle grower's association, the New Mexico farm and livestock bureau, the New Mexico association of conservation districts, the New Mexico home builders association, the realtors association of New Mexico, the New Mexico oil and gas association, the independent petroleum association of New Mexico and other interested groups meet in 2005 and diligently work toward developing legislation that can be supported by surface owners and subsurface producers; and

     BE IT FURTHER RESOLVED that the groups report their progress to the appropriate interim committee of the legislature prior to the second session of the forty-seventh legislature; and

     BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the New Mexico cattlegrower's association, the New Mexico farm and livestock bureau, the New Mexico association of conservation districts, the New Mexico home builders association, the realtors association of New Mexico, the New Mexico oil and gas association and the independent petroleum association of New Mexico.
