AN ACT

RELATING TO HEALTH INSURANCE; REQUIRING PROVIDERS OF MEDICAID PRESCRIPTION DRUGS TO OFFER HEALTH INSURANCE TO EMPLOYEES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. HEALTH INSURANCE REQUIREMENTS.--

          A. An employer who has a contract to provide prescription drugs to enrollees in the state medicaid program and who employs fifty or more employees shall offer health insurance benefits to all full-time or part-time employees.

          B. An employer who does not comply with the requirements of Subsection A of this section is prohibited from future contracts with the state for the purpose of providing prescription drugs.
