AN ACT

RELATING TO ENERGY; REQUIRING PROPANE DEALERS TO REPORT PRICES WEEKLY TO THE ATTORNEY GENERAL; PROVIDING A PENALTY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. PROPANE DEALERS--PRICE REPORTING.--

          A. By Tuesday of each week, each propane dealer in New Mexico shall report to the attorney general information for the preceding week's sales, including the daily price and the volume sold.

          B. The attorney general shall:

                (1) develop a propane sales database and reporting system;

                (2) prescribe the form for the reports;

                (3) adopt rules for carrying out the provisions of this section; and

                (4) report findings and recommendations to the legislature by the first day of each regular session.

          C. The taxation and revenue department shall cooperate with the attorney general to improve the data collection effort and identify additional data that should be collected.

          D. A propane dealer who fails to report as required by this section shall be subject to an administrative penalty of five hundred dollars ($500) per failure. Each failure to report shall constitute a separate offense.
