SUMMARY
Synopsis of Bill
House Bill 709 appropriates $35,000 from the general fund to the Local Government Division of
the Department of Finance and Administration for a visual and performing arts education pro-
gram for primary, secondary and post-secondary students in Otero County
FISCAL IMPLICATIONS
The appropriation of $35,000contained in this bill is a recurring expense to the general fund. Any
unexpended or unencumbered balance remaining at the end of fiscal year 2007 shall revert to the
general fund.
According to the Department of Finance and Administration, it does not appear that passage of
this bill would affect federal appropriations or other local, state or federal matching funds.

SIGNIFICANT ISSUES
According to the Department of Finance and Administration, this funding will be used for stu-
dents from Alamogordo, Tularosa, and Cloudcroft to attend performances at Flinkinger Center.
The Flinkinger Center for Performing Arts in Otero County provides visual and performing art
events for primary, secondary and post-secondary students free of charge.
ADMINISTRATIVE IMPLICATIONS
The Local Government Division would probably have to conduct an RFP process to comply with
the state procurement code and the anti-donation laws.
