SUMMARY
Synopsis of Bill
House Bill 772 appropriates $75,000 from the general fund to the New Mexico Higher Education
Department in order to provide continuing funding for the baseball program at Luna Community
College.
FISCAL IMPLICATIONS
The appropriation of $75,000 contained in this bill is a non-recurring expense to the general
fund. Any unexpended or unencumbered balance remaining at the end of fiscal year 2007 shall
revert to the general fund.
NMHED considers the $75,000 appropriation to be non-recurring since athletic programs are
considered to be Research and Public Service Projects (RPSP's) which are in addition to recur-
ring I&G monies. The appropriation would flow from MNHED to LCC

SIGNIFICANT ISSUES
This legislation was previously introduced during the 2005 legislative session, however last
year’s bill was not successfully enacted.
Athletics programs at higher education institutions are considered special projects. These pro-
jects are listed as Research and Public Service Projects (RPSPs) by colleges and universities
where they appear as line items in the budget. These programs are in addition to any Instruction
and General (I&G) budget appropriations that colleges or universities receive. As such, institu-
tions must annually submit their RPSP priority lists to NMHED for consideration.
This request, however, was not included in the LCC budget submission to NMHED. Conse-
quently, the funding request has neither been reviewed nor recommended by the New Mexico
Higher Education Department for inclusion in fiscal year 2007.
ADMINISTRATIVE IMPLICATIONS
Funding, if appropriated, would be administered through New Mexico Higher Education De-
partment, through their existing methods.
CONFLICT, DUPLICATION, COMPANIONSHIP, RELATIONSHIP
HB772 is a companion to SB621 which appropriates $300,000 to NMHED in FY07 for athletics
at Luna Community College (LCC), New Mexico Junior College (NMJC), and Mesalands
Community College (MCC).
WHAT WILL BE THE CONSEQUENCES OF NOT ENACTING THIS BILL
If this legislation is not enacted, the current baseball program at Luna Community College would
necessitate funding through other sources.
