SUMMARY
Synopsis of Bill
Senate Joint Memorial 38 requests that the New Mexico Department of Transportation
(NMDOT) perform a drainage and access study at Interstate 40 in the east Hasler Valley Corri-
dor in McKinley County.
FISCAL IMPLICATIONS
This bill does not commit nor appropriate any funding and therefore the DOT would have to per-
form the study internally or dedicate approximately $100,000 for the study. No additional fund-
ing or estimates would be available until the findings of the study and no funds have been identi-
fied for future costs.
SIGNIFICANT ISSUES
The NMDOT indicates that The major issues pertaining to the bill are the following:
This bill requires that the DOT perform a study and provide results to McKinley County and
the Indian Affairs Committee by September 1, 2006.

The site has access through NM 118 which is parallel to I-40 with interchanges on both east
and west sides of the valley which are approximately two (2) miles apart. Additional access
onto I-40 would require approval by the Federal Highway Administration under the interstate
access policy.
ADMINISTRATIVE IMPLICATIONS
OT would be responsible for managing and administering the study, thereby an administrative
impact to the agency.
WHAT WILL BE THE CONSEQUENCES OF NOT ENACTING THIS BILL
The consequences of not enacting this bill would defer any perceived problems or issues associ-
ated with flooding and the need for additional access at this location of Interstate 40.
