A JOINT RESOLUTION

GRANTING PRIOR APPROVAL TO THE PROPERTY CONTROL DIVISION OF THE GENERAL SERVICES DEPARTMENT TO LEASE LAND AT THE SOUTHWEST CORNER OF STATE ROAD 314 AND MORRIS ROAD TO VALENCIA COUNTY FOR THE PURPOSE OF CONSTRUCTING A NEW COURTHOUSE.

 

     WHEREAS, Section 13-6-3 NMSA 1978 requires ratification and approval of any lease of state-owned property for more than twenty-five years; and

     WHEREAS, House Joint Resolution 16 of the first session of the forty-seventh legislature authorized the property control division of the general services department to lease land to Valencia county for constructing a new courthouse at the Los Lunas medical center, but that land is not available for lease for the purposes of a courthouse; and

     WHEREAS, subject to further negotiations, a ten-acre site owned by the state of New Mexico under the control of the property control division of the general services department has been identified as an appropriate location to construct a new county courthouse; and

     WHEREAS, the following described property, consisting of ten acres more or less at the southwest corner of state road 314 and Morris road in Los Lunas, New Mexico is the site selected for construction of the new courthouse:

     A certain parcel of land situate within Tract 4, Harlan Ranches as the same is shown and designated on the plat, filed in the office of the County Clerk of Valencia County, New Mexico on the 7th day of January, 1938 (C-15-64), also being designated as a portion of Tract 2B1A1, Middle Rio Grande Conservancy District Property Map No. 80, situate within the San Clemente Grant, Projected Section 33, Township 7 North, Range 2 East, New Mexico Principal Meridian, Valencia County, New Mexico, and being more particularly described by metes and bounds as follows:

Beginning at the northwest corner of the parcel herein described, a point on the westerly right-of-way line of New Mexico state highway 314, as the same is shown and designated on New Mexico State Highway Commission Right-of-Way Map, New Mexico Project No. IN-025-3(1) 192 dated July 19, 1956, whence the northeast corner of said Tract 4 and said Tract 2B1A1 bears N 10° 06' 00" E, a distance of 20.00 feet and whence NGS Control Station P423 bears N 10° 24' 06" E, a distance of 1,065.59 feet;

Thence, continuing along said westerly right-of-way line of New Mexico State Highway No. 314, S 10° 06' 00" W, a distance of 831.74 feet, to the southeast corner of the parcel herein described;

Thence N 85° 20' 07" W, a distance of 518.79 feet, to the southwest corner of the parcel herein described;

Thence N 11° 32' 00" E, a distance of 893.53 feet, to the northwest corner of the parcel herein described;

Thence S 78° 28' 00" E, a distance of 494.26 feet, to the northeast corner and point of beginning of the parcel herein described and containing 10.000 acres more or less; and

     WHEREAS, the village of Los Lunas, Valencia county, the corrections department and the general services department have agreed that the described property should be used for a county courthouse; and

     WHEREAS, the general services department has agreed that it would be in the best interest of the state for the property control division to lease the described property in Los Lunas, New Mexico for a period of ninety-nine years for the purpose of constructing a new county courthouse;

     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the property control division of the general services department be authorized to lease ten acres more or less at the southwest corner of state road 314 and Morris road in Los Lunas, New Mexico for a period not exceeding ninety-nine years to Valencia county for the purpose of constructing a new county courthouse and that lease be hereby ratified and approved; and

     BE IT FURTHER RESOLVED that House Joint Resolution 16 of the first session of the forty-seventh legislature be superseded; and

     BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the property control division of the general services department, the secretary of corrections, the board of trustees of the village of Los Lunas, the board of county commissioners of Valencia county and the thirteenth judicial district court.
