A JOINT RESOLUTION

PROPOSING AN AMENDMENT TO THE CONSTITUTION OF NEW MEXICO TO PROVIDE THAT A PERSON WHO HOLDS AN OCCUPATIONAL LICENSE FROM THE STATE AND WHO, IN GOOD FAITH, PROVIDES SERVICES VOLUNTARILY, WITHOUT THE EXPECTATION OF COMPENSATION, SHALL NOT BE HELD LIABLE FOR ANY CIVIL DAMAGES AS A RESULT OF AN ACT OR OMISSION IN PROVIDING THOSE SERVICES.

 

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. It is proposed to amend the constitution of New Mexico by enacting a new section to read:

     "A person who is licensed by the state to practice an occupation and who, in good faith, provides services voluntarily within the scope of that license, without the expectation of compensation, shall not be held liable for any civil damages as a result of an act or omission in providing those services."

     Section 2. The amendment proposed by this resolution shall be submitted to the people for their approval or rejection at the next general election or at any special election prior to that date that may be called for that purpose.
