AN ACT

RELATING TO LIQUOR SALES; PROHIBITING THE SALE OF REFRIGERATED ALCOHOLIC BEVERAGES FOR CONSUMPTION OFF THE LICENSED PREMISES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Liquor Control Act is enacted to read:

     "[NEW MATERIAL] SALE OF REFRIGERATED ALCOHOLIC BEVERAGES PROHIBITED.--

          A. It is a violation of the Liquor Control Act for a licensee to sell, offer for sale or possess with intent to sell for consumption off the licensed premises alcoholic beverages that have been refrigerated or otherwise cooled or chilled in any manner. 

          B. The provisions of Subsection A of this section do not apply to a closed container of beer with a capacity of five or more gallons."

     Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2007.
