AN ACT

RELATING TO STATE HIGHWAYS; REQUIRING LEGISLATIVE APPROVAL OF CERTAIN PROPOSED RESTRICTIONS ON USE OF CERTAIN STATE HIGHWAYS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. LIMITATION ON USE OF STATE HIGHWAYS--LEGISLATIVE APPROVAL.--A state agency or other state or local authority that wishes to prohibit travel by commercial motor vehicles for more than two years on a segment of state highway shall obtain approval from the legislature before the prohibition is effective if the highway segment is located in a class A county with a population greater than three hundred thousand persons, provided that this section does not apply to emergency restrictions, restrictions due to structural or safety concerns or restrictions required by state highway maintenance and construction activities.
