AN ACT

RELATING TO PUBLIC SCHOOLS; REQUIRING HIGH SCHOOLS TO OFFER AT LEAST ONE ADVANCED PLACEMENT COURSE; CREATING AN ADVANCED PLACEMENT ADVISORY BOARD; PROVIDING DUTIES; CREATING A FUND; PROVIDING FOR AN ALLOCATION TO SCHOOL DISTRICTS; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Public School Code is enacted to read:

     "[NEW MATERIAL] ADVANCED PLACEMENT ADVISORY BOARD--APPOINTMENT--DUTIES.--

          A. The secretary shall appoint an "advanced placement advisory board" composed of advanced placement teachers, pre-advanced placement teachers and school administrators from around the state. The secretary shall include teachers and administrators from the largest school district as well as from other large, middle, small and rural school districts and charter schools. Subject to availability of funding, members may receive per diem and mileage but shall receive no other compensation, perquisite or allowance.

          B. The advanced placement advisory board shall advise the department on the best use of advanced placement funding to support teachers and the classroom, including recommendations for:

                (1) curricula for the advanced placement summer institute;

                (2) other professional development programs that would benefit advanced placement and pre-advanced placement teachers; and

                (3) professional development providers."

     Section 2. A new section of the Public School Finance Act is enacted to read:

     "[NEW MATERIAL] ADVANCED PLACEMENT FUND--ALLOCATIONS.--

          A. The "advanced placement fund" is created as a nonreverting fund in the state treasury. The fund consists of state and federal appropriations for advanced placement and gifts, grants and donations to the fund. The fund shall be administered by the department, and money in the fund is appropriated to the department to carry out the purposes of the fund. Expenditures from the fund shall be on warrant of the secretary of finance and administration based on vouchers signed by the secretary of public education or the secretary's authorized representative.

          B. Money in the advanced placement fund shall be used to:

                (1) support the advanced placement summer institute, which shall be free to New Mexico teachers; and

                (2) allocate money to public schools as provided in Subsection C of this section.

          C. Each school district and charter school shall receive fifty dollars ($50.00) for each advanced placement student score of 3, 4 or 5. Money received from this distribution shall be used only to enhance a school district's or charter school's advanced placement program, including professional development."

     Section 3. A new section of Chapter 22, Article 13 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] ADVANCED PLACEMENT COURSES REQUIRED.--Each high school in New Mexico shall offer at least one advanced placement course. The course may be offered through an approved distance learning advanced placement course."

     Section 4. APPROPRIATION.--Two million dollars ($2,000,000) is appropriated from the general fund to the advanced placement fund for expenditure in fiscal year 2008 and subsequent fiscal years to carry out the purposes of the fund. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
