FOR THE LEGISLATIVE HEALTH AND HUMAN SERVICES COMMITTEE

 

AN ACT

MAKING AN APPROPRIATION FOR A COST-OF-LIVING INCREASE FOR MEDICAID WAIVER PROGRAMS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--

          A. Eleven million five thousand dollars ($11,005,000) is appropriated from the general fund for expenditure in fiscal year 2008 for a cost-of-living increase to medicaid waiver programs as follows:

                (1) nine million two hundred forty thousand dollars ($9,240,000) to the department of health for developmental disabilities, HIV-AIDS and medically fragile children waivers; and

                (2) one million seven hundred sixty-five thousand dollars ($1,765,000) to the human services department for disabled and elderly waivers.

          B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2008 shall revert to the general fund.
