AN ACT

RELATING TO PUBLIC LANDS; PROVIDING A PROCESS TO RETURN CERTAIN STATE-OWNED LANDS TO THE TIERRA AMARILLA LAND GRANT-MERCED UNDER CERTAIN CONDITIONS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. RETURN OF LANDS TO THE TIERRA AMARILLA LAND GRANT-MERCED--CONDITIONS.--The state game commission shall transfer ownership to the Tierra Amarilla land grant-merced those unoccupied lands under the commission's control that have been identified as being located within the historic boundaries of that community land grant-merced if:

          A. the land grant-merced is recognized and operating as a political subdivision of the state pursuant to the provisions of Chapter 49, Article 1 NMSA 1978;

          B. the land grant-merced identifies its historic boundaries by a survey adequate to ascertain that the land is within the historic boundaries of that land grant;

          C. the transfer is conditioned upon the land becoming part of the common lands of the land grant-merced; and

          D. the land remains part of the common lands of the land grant-merced, provided that if the land does not remain part of the common lands, the land shall revert to the state.
