    Your VOTERS AND ELECTIONS COMMITTEE, to whom has been referred

 

HOUSE BILL 988

 

has had it under consideration and reports same WITHOUT RECOMMENDATION, amended as follows:

 

     1. On page 1, line 14, after "AUTHORIZING" insert "AN ELECTION TO IMPOSE".

 

     2. On page 7, line 4, strike "--TAX LEVY".

 

     3. On page 7, line 5, strike the subsection designation "A.".

 

     4. On page 7, line 16, after the bracket insert a period and closing quotation marks.

 

     5. On page 7, strike lines 17 through 25 in their entirety, strike page 8 in its entirety and on page 9, strike lines 1 through 7 in their entirety and insert in lieu thereof the following new section:

 

     "Section 9. A new section of the Special Zoning District Act is enacted to read:

 

     "[NEW MATERIAL] TAX LEVY ELECTION AUTHORIZATION--PROCEDURES--PURPOSE.--

 

          A. A commission may adopt a resolution to submit to the voters of the district the question of whether a property tax at a rate not to exceed the rate specified in the resolution may be imposed annually upon the net taxable value, as that term is defined in the Property Tax Code, of property located within the district for the purpose of paying fixed overhead and administrative costs.

 

          B. The resolution shall specify the rate of the proposed tax, which shall not exceed one dollar ($1.00) on each one thousand dollars ($1,000) of net taxable value of property in the district and shall specify the date of the election at which the question of the imposition of the tax district shall be held.

 

          C. The question of the imposition of the property tax shall be called, conducted and canvassed on behalf of the district by the county or counties in which the district is situate and in substantially the same manner as provided in the Election Code for general or special elections called for that purpose. Upon certification, copies of the election results shall be mailed immediately to the department of finance and administration and the taxation and revenue department.

 

          D. If the property tax is approved by a majority of the voters voting on the issue, the county or counties conducting the election, at the direction of the commission, shall levy the tax and pay over the amount collected to the district.

 

          E. The commission shall reimburse the county or counties conducting the election for election and tax collection costs from the property tax levy proceeds."".,
