AN ACT

RELATING TO PUBLIC EDUCATION; PROVIDING ADDITIONAL CIRCUMSTANCES WHEN A PARENT OR GUARDIAN MAY BE REIMBURSED FOR TRANSPORTATION TO AND FROM SCHOOL.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Section 22-16-6 NMSA 1978 (being Laws 1967, Chapter 16, Section 224, as amended) is amended to read:

     "22-16-6. REIMBURSEMENT OF PARENTS OR GUARDIANS.--A local school board may, subject to regulations adopted by the [state board] department, provide per capita or per mile reimbursement to a parent or guardian:

          A. in cases where regular school bus transportation is impractical because of distance, road conditions or sparseness of population; [or]

          B. in cases where the local school board has authorized a parent to receive reimbursement for travel costs incurred by having a child attend a school outside the child's attendance zone; or

          C. in other cases where regular school bus transportation to and from the child's school is unavailable and the child is required to use alternative methods of transportation."
