AN ACT

RELATING TO STATE PURCHASES; REQUIRING THE STATE TO PURCHASE VEHICLES FUELED BY ALTERNATIVE ENERGY SOURCES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Section 15-8-7 NMSA 1978 (being Laws 1994, Chapter 119, Section 7) is amended to read:

     "15-8-7. PURCHASE OF STATE VEHICLES--PROCUREMENT CODE--EQUIPMENT.--

          A. All state vehicle purchases shall be pursuant to the provisions of the Procurement Code. All purchases of state vehicles, even those not assigned to the motor pool, shall be approved by the director.

          B. All vehicles purchased by a state agency shall be capable of being powered in full or in part by an energy source other than a conventional gasoline internal combustion engine, including electric power, hydrogen fuel cell, solar power, ethanol or biodiesel, or some combination thereof, or another alternative energy source, in the following manner:

                (1) twenty-five percent of vehicle purchases by 2008;

                (2) fifty percent of vehicle purchases by 2010;

                (3) seventy-five percent of vehicle purchases by 2012; and

                (4) one hundred percent of vehicle purchases by 2014.

          [B.] C. Subject to legislative appropriations and directives and the approval of the secretary, the director shall determine the type and number of state vehicles to be purchased each year and how they shall be equipped."
