AN ACT

RELATING TO THE PUBLIC PEACE, HEALTH, SAFETY AND WELFARE; CREATING THE COMMUNITY MENTAL HEALTH OUTPATIENT TREATMENT FUND; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Mental Health and Developmental Disabilities Code is enacted to read:

     "[NEW MATERIAL] FUND CREATED.--The "community mental health outpatient treatment fund" is created in the state treasury to be administered by the human services department. The fund consists of appropriations, gifts, grants, donations and bequests made to the fund. Money in the fund is subject to appropriation by the legislature. The state treasurer shall invest the fund as other state funds are invested, and earnings from investment of the fund shall be credited to the fund. All balances in the fund shall remain in the fund and shall not revert to the general fund. Money in the community mental health outpatient treatment fund shall be used to provide community outpatient mental health treatment services pursuant to rules promulgated by the human services department."
