    Your JUDICIARY COMMITTEE, to whom has been referred

SENATE BILL 486

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 1, line 14, after the comma insert "THE" and strike "TRAIL" and insert in lieu thereof "TRAILS".

    2. On page 1, line 22, underscore the subsection designation "A.".

    3. On page 2, line 4, underscore the subsection designation "B.".

    4. On page 2, line 11, strike "trail" and insert in lieu thereof "trails".

    5. On page 2, line 13, strike "liability" and insert in lieu thereof "immunity".

    6. On page 2, line 15, after "of" strike the remainder of the line and strike all of line 16 up to the period and insert in lieu thereof:

"such trails if the irrigation or conservancy district has entered into a written agreement with the state agency or local public body operating or maintaining the trail and that state agency or local public body has agreed to assume the operation and maintenance of that portion of the district's property used for the trail; the state agency or local public body operating or maintaining the trail shall be subject to liability as provided in the Tort Claims Act".
