    Your EDUCATION COMMITTEE, to whom has been referred

 

SENATE BILL 501, as amended

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

     1. Strike Senate Education Committee Amendments 2, 3, 5 through 7, 9, 10 and 13.

 

     2. On page 1, line 12, after "ASSESSMENTS", insert "; DECLARING AN EMERGENCY".

 

     3. On page 1, line 18, strike the first occurrence of "TESTS" and insert in lieu thereof "ASSESSMENTS" and strike the second occurrence of "TESTS" and insert in lieu thereof "ASSESSMENTS".

 

     4. On page 1, line 19, strike "TEST" and insert in lieu thereof "ASSESSMENTS".

 

     5. On page 2, lines 1 and 2, strike "academic performance tests" and insert in lieu thereof "assessments".

 

     6. On page 2, lines 6 and 7, strike "by the school year indicated".

 

     7. On page 2, line 8, strike "nine" and insert in lieu thereof "eight".

 

     8. On page 2, line 10, strike "by", strike lines 11 through 13 in their entirety and strike line 14 up to the semicolon.

 

     9. On page 2, line 15, strike "nine," and insert in lieu thereof "eight, a".

 

     10. On page 2, lines 18 and 19, strike "criterion-referenced tests by the 2005-2006 school year" and insert in lieu thereof "standards-based assessments".

 

     11. On page 2, line 21, strike "nine" and insert in lieu thereof "eight".

 

     12. On page 3, line 19, strike the ending quotation mark.

 

     13. On page 3, between lines 19 and 20, insert a new Subsection G and a new Section 2 to read:

 

          "G. Prior to establishing a preliminary unit value to establish school district and charter school budgets for the subsequent fiscal year, the department shall determine the amount of the state equalization guarantee distribution required to pay the district- and school-level costs of required academic assessments. Upon verification by the department of finance and administration and review by the legislative education study committee and the legislative finance committee, the required amount shall be transferred to the operating budget of the department. The provisions of this subsection are effective until July 1, 2010."

 

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.".,

 

and thence referred to the APPROPRIATIONS AND FINANCE COMMITTEE.
