Mr. Speaker:

 

    Your JUDICIARY COMMITTEE, to whom has been referred

 

SENATE BILL 820

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

     1. On page 1, between lines 23 and 24, insert the following subsection:

 

          "C. Upon conviction pursuant to this section, an offender shall be required to participate in and complete a domestic violence offender treatment program approved by the children, youth and families department pursuant to rules promulgated by the department that define the criteria for such programs.".

 

     2. Reletter the succeeding subsection accordingly.

 

     3. On page 2, line 3, after the period, insert the following:

 

"If an offender violates a condition of probation, the court may impose any sentence that the court could originally have imposed and credit shall not be given for time served by the offender on probation; provided that the total period of incarceration may not exceed three hundred sixty-four days and the combined period of incarceration and probation may not exceed two years.".

                                                                 

     4. On page 2, between lines 22 and 23, insert the following subsection:

 

          "D. Upon conviction pursuant to Subsection B of this section, an offender shall be required to participate in and complete a domestic violence offender treatment program approved by the children, youth and families department pursuant to rules promulgated by the department that define the criteria for such programs.".

 

     5. Reletter the succeeding subsection accordingly.

 

     6. On page 3, line 2, after the period, insert the following:
