Synopsis of Bill
House Bill 95 makes an Appropriation to Pay Expenses for Transferring Prisoners in Otero
County.
FISCAL IMPLICATIONS
Note: major assumptions underlying fiscal impact should be documented.
SIGNIFICANT ISSUES
DFA reports that, housing and transporting prisoners represents an enormous cost to counties.
For the most part, counties are not reimbursed for these expenses. If a county does not have
significant own-source revenues, the effect of paying for prisoner expenses may result in the
county cutting back on other services to the public. This appropriation would provide $100
thousand to help Otero County meet the cost for transferring prisoners.

PERFORMANCE IMPLICATIONS
The Local Government Division would need to determine the process and criteria required to
reimburse Otero County for transferring prisoner costs.
ADMINISTRATIVE IMPLICATIONS
House Bill 95 states the appropriation would be administered by the Department of Finance,
Local Government Division. The Division reports that it currently has a grant reimbursable
process in place, which could be mirrored for this appropriation.
WHAT WILL BE THE CONSEQUENCES OF NOT ENACTING THIS BILL
$100 thousand would not be appropriated to DFA for disbursal to Otero Country for prisoner
transport.
