SUMMARY
Synopsis of Bill
House Transportation and Public Works Committee Substitute for House Bill 249 requires
legislative approval of any prohibition of commercial motor vehicles on a segment of state
highways within class A counties with a population of more than 300 thousand persons for any
period exceeding two years.
FISCAL IMPLICATIONS
Indeterminate.
SIGNIFICANT ISSUES
This legislation would require approval of the state legislature for any prohibition of travel on a
segment of state highway for more than two years prior in a class A county with a population of
more than three hundred thousand (i.e. Bernalillo County) prior to the limitation becoming

effective. This however would not apply to emergency restrictions or restrictions based on
structural or safety concerns and would apply to every other type of restriction that the law
currently allows the state, federal government, local authorities and the Department to impose.
Currently this authority resides with local entities and NMDOT.
