SUMMARY
Synopsis of HFl#1 Amendment
The House Floor Amendment #! to the House Judiciary Committee substitute to House Bill 340
adds that if the board of trustees brings an action and judgment is rendered in favor of the board
of trustees, the court may award to the board of trustees possession of the tract, piece or parcel of
the land and such damages as it may have proved for the wrongful detention and any other
remedy provided for by law.
Synopsis of Original Bill
The House Judiciary Committee substitute for House Bill 340 enacts new sections of state law
setting forth detailed requirements for the governance of the Chilili Land Grant.
The government and control of the common lands of the Chilili land grant-merced, also known
as la merced del pueblo de Chilili, is vested in five trustees, to be known officially as the board
of trustees of the Chilili land grant-merced, who shall manage and control the land grant-merced
in accordance with the provisions of Chapter 49, Article 4 NMSA 1978."
The bill sets forth for the five member board of trustees their election procedures, qualifications,

salaries; duties and removal; define certain terms relating to the land grant; provide for sale of
land grant property; provide for removal and eviction proceedings against persons possessing
land grant property without holding title; and provide for the rights of person purchasing
property within the land grant.
FISCAL IMPLICATIONS
This bill has no fiscal impact.
SIGNIFICANT ISSUES
The title of the bill implies that its intent is to “conform" the Chilili land grant statutes to the
general land grant provisions, and therefore apply the general land grant provisions. If the
general land grant statutes conflict with the specific provisions applicable to the Chilili Land
Grant the former will apply.
