SUMMARY
Synopsis of Bill
House Bill 702 appropriates $50,000 from the General Fund to ALTSD for expenditure in FY08
to fund a pilot program extending hours for adult day care in San Miguel County to a full
workday.
FISCAL IMPLICATIONS
The appropriation of $50,000 contained in this bill is a recurring expense to the General Fund.
Any unexpended or unencumbered balance remaining at the end of FY 2008 shall revert to the
General Fund.
SIGNIFICANT ISSUES
An Adult day care center is a facility required to be licensed pursuant to these regulations which
provides care, services and supervision to three (3) or more adults, who because of diminished
mental or physical capacity find it difficult to care for themselves in their own residence during
the day. An adult day care center may be located in any building which meets the applicable
state, local building, and safety codes.

Adult Day Care Services is one component of the Home and Community-Based Service
Delivery System for older adults. Adult Day Care is a cost effective way to support caregivers in
the care of their loved ones.
The Aging and Long-Term Services Department adult day care programs are required to utilize
the licensing requirements set forth by the NM Department of Health, Public Health Division,
Health Facility Licensing and Certification Bureau (Regulations for Adult Day Care Facilities 7
NMAC 13.2).
The Department has stated that ALTSD has the capacity to implement the funding with existing
staff and systems.
OTHER SUBSTANTIVE ISSUES
The Aging and Long-Term Services Department points out that Senior Centers are the backbone
of the Aging Network. Senior Centers are the first point of contact for information about
resources and opportunities for seniors of all income and ability levels. More than 200 senior
centers serve New Mexico's senior populations. There are four Senior Centers in San Miguel
County:

Mora/San Miguel Senior Citizens, Inc.

Mora/San Miguel Pecos Senior Center
3.
Las Vegas Senior Center
4.
San Miguel Del Vado - Ribera
According to ALTSD, adult day care services are not currently available in San Miguel County
through Senior Centers. The opening of an adult day care facility in San Miguel County would
require licensing prior to implementation of services. The regulations address a wide range of
standards to ensure that participants receive safe and adequate services and that the health, safety
and welfare of participants and employees are protected.
The Adult Protective Services Division, under certain circumstances, can contract for the
provision of adult day care services to provide an organized, structured, community-based
program of therapeutic services and activities for adults with impaired ability to perform
activities of daily living. Adult day care is provided for two or more hours a day, on a regularly
scheduled basis, one or more days per week, in a licensed facility.
