Synopsis of Bill
House Bill 842 appropriates $100.0 from the General Fund to the Local Government Division of
the Department of Finance and Administration in FY08 for a use of force training program for
law enforcement personnel that is administrated by the City of Albuquerque Police Department.
FISCAL IMPLICATIONS
The appropriation of (AMOUNT) contained in this bill is a recurring expense to the General
Fund. Any unexpended or unencumbered balance remaining at the end of FY08 shall revert to
the General Fund.
SIGNIFICANT ISSUES
HB 842 appropriates $100.0 to support a use of force training program for the Albuquerque
Police Department (APD). According to a Deputy Chief at the Department of Public Safety, this
program is a reactive control model (RCM) that trains an officer what level of force to use for
given situations.

The APD Deputy Chief of Training and Recruiting explained that the $100.0 in HB 842 will be
used to teach use of force to Albuquerque, Rio Rancho, and Bernalillo County law enforcement
officers. The training would be conducted by Louis Robles (an attorney and expert in police use
of force). Mr. Robles has developed a class (and book) based upon his experience
defending many law enforcement officers. He has incorporated his legal knowledge with that
experience to develop training that will decrease law enforcement's legal exposure while
maintaining the ability to react appropriately to defend themselves and others.
The training will be hosted at the Albuquerque Police Department and will include all the new
required manuals for approximately 1,500-1,800 officers. This is a one-time training that will
facilitate a train-the-trainer program within the academy. Currently, different models for use of
force exist and are required training within the academy curriculum.
ADMINISTRATIVE IMPLICATIONS
The DFA Local Government Division would be the fiscal agent for the funding and APD is the
primary responsible agency to administer the provisions of HB 842. According to DFA staff,
they would have to implement a Memorandum of Understanding or a Joint Powers Agreement
with the City of Albuquerque to responsibly administer the funding.
