Synopsis of Bill
House Appropriation and Finance Committee Substitute for House Bill 1303 adds a new section
of the Mental Health and Developmental Disabilities Code that creates the /Community Mental
Health Outpatient Treatment Fund. The fund is created in the State Treasury and administered
by the Human Services Department. The fund consists of appropriations, gifts, grants, donations
and bequests made to the fund and the monies are subject to appropriation by the Legislature.
The funds are not subject to reversion. Money in the fund is to be used to provide community
outpatient mental health treatment services pursuant to rules promulgated by the Human Services
Department.
FISCAL IMPLICATIONS
This bill has not fiscal implications.
SIGNIFICANT ISSUES
It is uncertain what issue the bill is addressing. Mental health treatment is required in all
segments of the state and generally addressed through appropriations made to agencies for that
purpose. However, the need to introduce into the process an intermediary fund with separate
rules directed only at outpatient services is not apparent.
