SUMMARY
Synopsis of SFC Amendment
The amendment mandates that a municipality within a class A county with a population of
500,000 or greater will contribute funds to the county in an amount equal to a minimum of 25%
of the operating costs of the county detention facility as opposed to the 15% included in the
original bill and committee substitute/
Synopsis of Original Bill
Senate Bill 744 addresses the issue of placement of certain municipal inmates in county
detention facilities, provides for redistribution of the local government corrections fund and
establishes a fee for the placement of certain municipal inmates in county detention facilities.
SIGNIFICANT ISSUES
SB 744 creates a Local Government Corrections Fund that will be administered by the
Administrative Office of the Courts.

Disbursement from the Fund may be used by a county or municipality with a metropolitan court
for:
County or municipal jailer or juvenile detention training
The construction planning, construction, maintenance and operation of county detention
facilities, municipal jails or juvenile detention facilities
Paying the cost of housing county or municipal prisoners or juveniles in any detention
facility in the state
Alternative to incarceration
Complying with match or contribution requirements for the receipt of federal funds
related to detention facilities, jails or juvenile detention facilities
Counties are eligible for payment in an amount equal to the costs and fees collected by a
magistrate court or a metropolitan court and the motor vehicle division pursuant to offense
committed within the county and deposited in the Fund.
SB 744 adds a new section to Chapter 33, Article 3 NMSA 1978 mandating that a municipality
in a Class A county with a population of 500,000 or greater shall contribute funds to the county
in an amount that is equal to a minimum of 25% of the operating costs of the county detention
facility.
