Synopsis of Original Bill

Senate Bill 782 amends NMSA 1978 60-2B-1, also known as the Bingo and Raffle Act. This

amendment would allow the New Mexico State Fair to host bingo and conduct raffles on the

fairgrounds during the state fair. GCB indicates the amendment authorizes the fair to license

qualified organizations to apply to the state fair to have raffles and retain the licensing fee.

FISCAL IMPLICATIONS

The New Mexico State Fair Commission reports SB 782 would greatly increase its indirect

revenue while retaining the licensing fees from fees collected, bingo returns, and raffle tickets

sold, no estimated figures were provided by the agency.

SIGNIFICANT ISSUES

This bill will allow the State Fair to host bingo and conduct raffles and allow outside qualified

organizations the ability to apply for a license and conduct raffles during the fair on the

fairgrounds. The fair would pay a $100 licensing fee, per calendar year to GCB. According to

the fair, organizations applying for a license would pay the required fee of $100 to the fair but

must obtain approval from both the GCB and State Fair Commission. GCB indicates the bill not

does establish an administrative licensing process; ie, application procedure and review. Should

one licensing authority approve a license and the other does not, who has the final say.

GCB indicated this bill creates a dual licensing authority between them and the State Fair

Commission.
