Synopsis of HAGC Amendment
House Agriculture and Water Resources Committee amendment to Senate Bill 886 reflects the
following language:
1. On page 2, line 15, strike "related" and after "infrastructure" insert "for the
delivery of water to the location of need".
2. On page 3, line 6, after "condemnation" insert "and may only condemn real
property when that property is needed for infrastructure related to the conveyance of
water".
The amendment adds “need" criteria to payments for administrative and infrastructure costs, as
well as condemnation activities. The amendment adds no appropriation language.

Synopsis of Original Bill
Senate Bill 886 seeks to amend Section 72-14-3.3 (A) (the Strategic Water Reserve Act) to
explicitly allow the interstate stream commission to use strategic water reserve funding to
develop, construct, operate and maintain infrastructure related to the strategic water reserve
purposes.
There is no appropriation attached to this legislation.
SIGNIFICANT ISSUES
The Office of the State Engineer, Interstate Stream Commission notes that an example of how
this amendment would be applied would be to make it clear that the interstate stream
commission could use strategic water reserve related funding to construct, operate and maintain a
pipeline to deliver water that it purchased through the strategic water reserve from a well to the
river where the water is needed for compact or endangered species purposes consistent with the
directives in the existing legislation.

The Office of the State Engineer, Interstate Stream Commission opines that the authority of the
interstate stream commission to develop, construct, operate and maintain infrastructure related to
the strategic water reserve would not be as clear as it would be if this bill is enacted.
