SUMMARY
Synopsis of SFl Amendment
Senate Floor Amendment #1 to Senate Bill 1098 removes language relating to home school
students choosing to participate in activities at a school other than the one in the attendance zone
in which the student resides. It appears that this provision precludes home school students
choosing where they will participate.
Synopsis of SEC Amendment
The Senate Education Committee amendment to Senate Bill 1098 clarifies that home school
students are eligible to participate in athletic activities in only one school district and provides
that the school district shall verify each home school student’s academic eligibility to participate.
Synopsis of Original Bill
Senate Bill 1098 adds the home school student activities program unit into the program cost
calculation provides for a cost differential factor and establishes home school student eligibility
to participate in school district activities.

FISCAL IMPLICATIONS
Senate Bill 1098 does not contain an appropriation. The cost differential factor of 0.1 times the
number of home school students participating in school district activities would be minimal for
most districts except for Albuquerque, which has the highest concentration of home school
students within its boundaries.
SIGNIFICANT ISSUES
At present, the funding formula study taskforce is involved in overseeing a contractor
undertaking a complete review of the funding formula. Recommendations from the taskforce
will be presented to the Legislature in the fall of 2007, in time for consideration by the 2008
legislative session.
The Legislature may wish to delay changes to the program cost calculations until results of the
study are complete.
The bill provides that home school students are eligible to participate in school district activities
at the public school in the attendance zone in which the student resides and further provides that
home school students shall be subject to New Mexico Activities Association guidelines.
