SUMMARY
Synopsis of Bill
Senate Bill 1168 proposes a new section to the Special Hospital District Act authorizing
individual county commissioner to form special hospital districts, providing procedures for the
appointment and election of the board of trustees, and delegating their powers and duties.
SIGNIFICANT ISSUES
DOH reports that SB 1168 proposes a new section to the Special Hospital District Act to allow,
by majority vote, the county commissioners of an individual county to create within their
respective jurisdiction, a special hospital district with the additional authority to appoint a board
of trustees. This new section differs from the existing Act in as much that the previous language
provided all counties the authority to “enter into agreements with one or more other counties to
create special hospital districts composed of all or a portion of each county" (See §4-48A-3B
NMSA 1978). Thus the new section enables each county to unilaterally act in creating a special
hospital district without entering into agreements with neighboring counties.

OTHER SUBSTANTIVE ISSUES
The proposed new section of SB 1168 expands the existing authority of an individual board of
county commissioners within the state to unilaterally act by a majority vote in the creation of a
special hospital district.
