SUMMARY
Synopsis of HVEC Amendment
The House Voters and Elections Committee amendment strikes the Senate Rules Committee
amendments.
Synopsis of SRC Amendment
Senate Rule Committee amendment removes the provision that required consent of both houses
of the legislature when a governor fills a vacancy to the office of Lieutenant Governor and
replaces it with a provision that requires consent of the Senate.
Synopsis of Original Bill
Senate Joint Resolution 9 proposes to amend Article 5 of constitution of New Mexico to provide
that, in the case of a vacancy in the office of Lieutenant Governor, the Governor shall fill the
vacancy by appointment with the consent of the both the House and the Senate.
FISCAL IMPLICATIONS
Secretary of State may incur additional expenses to place this proposal on the ballot at the next
general election. The exact costs are unknown but should be minimal.

SIGNIFICANT ISSUES
Article 5, Section 5 provides for the Governor’s power to make appointments to state offices
with the exception of a vacancy in the Office of Lieutenant Governor and members of the
Legislature. Article 5, Section 7 provides for succession to the governorship.
