A MEMORIAL

REQUESTING THE ADMINISTRATIVE OFFICE OF THE COURTS, THE ADMINISTRATIVE OFFICE OF THE DISTRICT ATTORNEYS AND THE NEW MEXICO ASSOCIATION OF COUNTIES TO CONTINUE TO STUDY THE STATUTORY REQUIREMENTS THAT COUNTIES PROVIDE FACILITIES FOR DISTRICT COURTS AND DISTRICT ATTORNEYS.

 

     WHEREAS, Senate Joint Memorial 22, a memorial passed in the 2005 regular legislative session, required representatives of the administrative office of the courts, the administrative office of the district attorneys and the New Mexico association of counties to meet and develop a definition of who pays what for court and district attorney facilities; and

WHEREAS, the administrative office of the courts, the administrative office of the district attorneys and the New Mexico association of counties met and developed recommendations that were reported to the courts, corrections and justice committee; and

     WHEREAS, one of the recommendations was to determine whether, as part of a long-term plan, security personnel should be funded by the state for purposes of control and statewide consistency; and

     WHEREAS, another of the recommendations was to determine whether, as part of a long-term plan, the state should take over more of the funding of these facilities; and

           WHEREAS, the counties and the state would benefit from further discussion on the topic of security personnel and whether the state should take over more of the funding of the facilities;     

     NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE OF NEW MEXICO that the administrative office of the courts, the administrative office of the district attorneys and the New Mexico association of counties be requested to have further discussion on the topic of security personnel and facility funding and to develop recommendations from these discussions; and

      BE IT FURTHER RESOLVED that the administrative office of the courts, the administrative office of the district attorneys and the New Mexico association of counties report their

findings to the appropriate legislative interim committee no later than November 30, 2007; and

     BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the administrative office of the courts, the administrative office of the district attorneys and the New Mexico association of counties.
