SUMMARY
Synopsis of Bill
House bill 297 appropriates $45,000 from the general fund to the administrative office of the
courts for a full-time court security and probation officer position with the San Miguel county
magistrate court. Unused funds shall revert at the end of FY 09.
FISCAL IMPLICATIONS
This appropriation should go to the County of San Miguel, not the administrative office of the
courts.

SIGNIFICANT ISSUES
This appropriation request is not part of the judiciary’s unified budget. Forty-five thousand
dollars should be appropriated to the County of San Miguel to hire a deputy sheriff to be devoted
to the San Miguel County Magistrate Court.
PERFORMANCE IMPLICATIONS
The courts are participating in performance-based budgeting. It is unknown if enactment of this
bill will impact performance measures as they relate to judicial budgeting.
TECHNICAL ISSUES
Amend the bill so that the appropriation goes to San Miguel County to hire a deputy sheriff for
the San Miguel County Magistrate Court.
WHAT WILL BE THE CONSEQUENCES OF NOT ENACTING THIS BILL
San Miguel County will not receive a deputy sheriff devoted to their magistrate court.
