SUMMARY
Synopsis of Bill
House Bill 446 appropriates $25 thousand from the general fund to the State Fair Commission
for the African American Performing Arts Center and Exhibit Hall (AAPAC) to provide
programs and resources to improve the mathematics, science and literacy skills of elementary,
middle and high school students, including after-school, weekend and summer activities and
web-based resources that provide individualized opportunities to develop skills.
FISCAL IMPLICATIONS
The appropriation of $25 thousand contained in this bill is a recurring expense to the general
fund. Any unexpended or unencumbered balance remaining at the end of FY09 shall revert to the
general fund.
SIGNIFICANT ISSUES
According to the PED, the appropriation will support core academic education programs and
special activities at the AAPAC. The programs include a web-based, individualized mathematics

tutoring program that adapts to a student’s specific academic needs as well as tutoring programs
in reading/language arts and science. These programs are aligned to the New Mexico content
standards and focus on core skills that students need to improve their proficiency in their regular
classrooms and courses.
The AAPAC includes an arts laboratory, a learning technologies lab, and a theatre with all
supporting services. Students are currently attending after-school activities and this bill will
expand the number of students served as well as the number of programs that can be offered.
PED has provided the following New Mexico Standards-Based Assessment (NMSBA) data
indicate the need for programs and activities that would enhance learning and narrow the
achievement gap:

PERFORMANCE IMPLICATIONS
PED reports this bill aligns with the public school support performance measures of the percent
of elementary and middle school students who achieve the No Child Left Behind Act annual
measurable objective for proficiency of above on the standards-based assessments in
mathematics and reading and language arts.

HB6 – appropriates $348 thousand to the SFC for operation of the AAPAC.
HB103 – appropriates $32 thousand to the SFC for the Charlie Morrisey Children’s Theater
Program at the AAPAC.
HB107 – appropriates $25 thousand to the SFC for transportation costs for transporting
participants to programs or events at the AAPAC.
HB226 – creates an African American Performing Arts Center and Exhibit Hall Authority. The
bill appropriates $450 thousand to an AAPAC fund.
