Synopsis of Original Bill
House Bill 449, Making an Appropriation to Expand Employment Opportunities for Persons
with Disabilities, appropriates $60.0 thousand from the general fund to DFA for the purpose of a
full-time employee to implement the State Use Act program.
FISCAL IMPLICATIONS
The appropriation of $60.0 thousand contained in this bill is a recurring expense to the general
fund. Any unexpended or unencumbered balance remaining at the end of FY09 shall not revert to
the general fund.

SIGNIFICANT ISSUES
GSD notes that
The bill does not appropriate the funding to a specific division within the general services
department, but is consistent with the statutory authority of the Purchasing Division.
The position is designed to promote the State Use Act with state agencies and local
public bodies and to monitor contracts issued by state agencies for services to ensure
compliance with the Act.
This bill is supported by the Association of Developmental Disability Community
Providers.
DOH notes that the State Use Act was passed by the Legislature and approved by the Governor
as a result of the 2005 Legislative Session. The State Use Act created a New Mexico Council
that has the authority to establish “fair market" prices for goods and services provided by non-
profit Community Rehabilitation Programs serving people with disabilities. The Council was
charged with establishing a procedure for the approval and monitoring contracts with non-profit
agencies.
As the State Use Act relates to individuals with developmental disabilities, currently, Department
of Health (DOH) initiatives promote individual business ownership as well as inclusive
community employment at competitive wages.
AMENDMENTS
GSD suggests that to clarify which organization unit in GSD is responsible for implementing the
State Use Act, the following amendment could be offered:
