Synopsis of Original Bill

Senate Bill 300 appropriates $60 thousand from the general fund to the Vocational Rehabilitation

Division of the Public Education Department to implement the State Use Act to expand

employment opportunities for persons with disabilities.

FISCAL IMPLICATIONS

The appropriation of $60 thousand contained in this bill is a recurring expense to the general

fund. Any unexpended or unencumbered balance remaining at the end of FY09 shall revert to

the general fund.

SIGNIFICANT ISSUES

Analysis from the agencies suggests that the wording “Division of Vocational Rehabilitation of

the Public Education Department" is a drafting error. It is the intent of the Development

Disability Community Providers that these funds be allocated to the State Purchasing Office of

Senate Bill 300/aSPAC – Page

the General Services Department. This is consistent with the language in the State Use Act and

would be a more appropriate governmental function for GSD as it relates to the statewide

procurement of services from persons with disabilities by governmental entities.

The State Use Act (NMSA 13-1C) was established by New Mexico Legislation in 2005. The

Act relating to persons with disabilities provided a rulemaking process through the New Mexico

State Council for Purchasing from Persons with Disabilities, to identify services to be purchased

from community rehabilitation programs or qualifying individuals with disabilities.

The New Mexico Council for Purchasing from Persons with Disabilities established through the

State Use Act oversees the rule making process published in the New Mexico Register (Title 2,

Chapter 40, Part 5, 2.40.5.1) March 30, 2007.
