Synopsis of Bill
The Senate Finance Committee Substitute for Senate Bill 333 authorizes $223.8 million from
General Obligation Bond (GOB) capacity for the purpose of funding capital outlay needs within
four bond issues: senior center capital outlay facilities and equipment, library acquisitions,
health facilities, and higher education and special schools.
Synopsis of Original Bill
Senate Bill 333 authorizes $223.8 million from General Obligation Bond (GOB) capacity for the
purpose of funding higher education, special school, senior citizen center, public school
education facilities and equipment; and for public school, academic, and public library
acquisitions.
FISCAL IMPLICATIONS
The authorization of $223.8 million contained in this bill, including $372,000 for the cost of
issuance of the bonds, is a non-recurring expense to GOB capacity. The state agencies and state
institutions to which money has been appropriated in this bill shall be responsible for monitoring
the projects funded in the Act to ensure compliance with the Constitution and laws of New
Mexico and shall cause to be reverted any unexpended or unencumbered balance remaining at
the earlier of the third full fiscal year after issuance of the bonds or the termination or completion

of the specific project. Reverted funds shall be deposited in the debt service fund established by
the state treasurer for the purpose of paying the principal of and interest on the state’s general
obligation bonds.
Issuance of general obligation bonds requires approval by the electorate in the 2008 November
general election. General obligation bonds are payable from ad valorem (property) taxes levied
on all property in the state subject to property taxation. The bonds are backed by the full faith
and credit of the state.
If ratified by the voters, the statewide authorizations proposed in this bill include: $14.7 million
for senior citizen facilities and equipment, $11 million for library acquisitions, $57,828 million
for heath-related facilities, and $139.9 million for higher education and special school facilities.
A spreadsheet listing the recipients and proposed allocations within Senate Finance Committee
Substitute for Senate Bill 333 for higher education and special school facilities and senior citizen
centers is attached.
The $11 million for library acquisitions is allocated as follows: $3 million for public school
libraries statewide, $3 million for public libraries statewide, $3 million for academic libraries
statewide, and $2 million for tribal libraries statewide.
General obligation bonds are issued by the Board of Finance in December or January following
the general election. Funds authorized in this bill will be available to the recipients between
March and April 2009.
SIGNIFICANT ISSUES
General obligation bond capacity is available only in even-numbered years. Historically, the
most commonly supported issues by the electorate include projects for higher education, senior
center facilities, public school facilities, and libraries. State-owned and operated buildings,
equipment, and land acquisitions have not been popular with the voters and have been voted
against in the last 10 years.
