SUMMARY
Synopsis of Bill
The Senate Corporations and Transportation Committee Substitute for Senate Bill 562 amends
Section 9-19-6 NMSA 1978 with technical clean-up language and the following new language to
“provide for overtime pay from the local DWI grant fund to special investigation division
officers who provide community relations services."
FISCAL IMPLICATIONS
There will be a fiscal impact to the Local DWI Grant Fund to pay for overtime for the Special
Investigation Division officers who provide community relations services.
SIGNIFICANT ISSUES
In 1993, the legislature passed the local DWI Grant Program Act creating the Local DWI Grant
Program Fund, administered by the Local Government Division of the Department of Finance
Administration. The fund is to make grants to municipalities and counties for DWI-related
programs. The purpose of the Local DWI Grant Program Fund has expanded to include a wide
range of substance abuse-related state and local programs. The same Act created the DWI

Program Fund to support state agencies’ DWI-related activities. Initially, the Legislature
appropriated $5.5 million to the Local DWI Grant Program Fund and $5.1 million to the DWI
Program Fund. In ensuing years, annual appropriations from the general fund to the Local DWI
Grant Program Fund were replaced by dedicated revenue of 34.57 percent of the net receipts
from the state liquor excise tax. Annual appropriations from the general fund to the DWI
Program Fund were discontinued, and programs funded from the original appropriation were
rolled into agency base budgets.
PERFORMANCE IMPLICATIONS
The proposed legislation could positively impact the following performance measures for the
Department of Public Safety:
Number of administrative citations issued to licensed liquor establishments for the illegal
sales or service of alcohol to minors and intoxicated persons by the Special Investigation
Division; and
Number of criminal citations or arrests for the illegal sales or service of alcohol to minors
and intoxicated persons by the Special Investigation Division.
OTHER SUBSTANTIVE ISSUES
In calendar year 2005, New Mexico ranked eighth in the nation for alcohol-related fatalities per
100,000 motor vehicle miles traveled. In 2006, alcohol-related fatalities in the state decreased by
12.8 percent. This is the lowest rate per 100,000 ever recorded. DPS reported that in FY07
alcohol-related fatalities in New Mexico were down 20.1 percent from FY06.
