AN ACT

RELATING TO CONSTRUCTION; CREATING THE CONSTRUCTION CRIMES BUREAU; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Construction Industries Licensing Act is enacted to read:

     "[NEW MATERIAL] CONSTRUCTION CRIMES BUREAU CREATED.--

          A. The "construction crimes bureau" is created in the division.

          B. The construction crimes bureau shall:

                (1) investigate alleged crimes committed by a person licensed by the division in the course of performing any act for which a license is required; and

                (2) pursue prosecution against, or cooperate in the prosecution of, a person licensed by the division against whom criminal charges are filed, in coordination with the law enforcement agency having prosecutorial authority over the crime."

     Section 2. APPROPRIATION.--Two million dollars ($2,000,000) is appropriated from the general fund to the construction industries division of the regulation and licensing department for expenditure in fiscal years 2010 and 2011 to implement the creation of the construction crimes bureau and to fill the necessary full-time-employee positions in the legal, financial and investigative classifications to carry out the duties of the construction crimes bureau. Any unexpended or unencumbered balance remaining at the end of fiscal year 2011 shall revert to the general fund.

     Section 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2009.
