FOR THE ECONOMIC AND RURAL DEVELOPMENT COMMITTEE

 

AN ACT

RELATING TO THE LEGISLATURE; CREATING THE ECONOMIC AND RURAL DEVELOPMENT COMMITTEE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of Chapter 2 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] ECONOMIC AND RURAL DEVELOPMENT COMMITTEE--CREATED--MEMBERS--APPOINTMENT--TERMS.--

          A. The "economic and rural development committee" is created as a joint interim committee of the legislature.

          B. The committee shall be composed of sixteen members. The New Mexico legislative council shall appoint eight members from the house of representatives and eight members from the senate. At the time of making the appointment, the legislative council shall designate the chair and vice chair of the committee.

          C. Members shall be appointed so as to give the two major political parties in each house the same proportionate representation on the committee as prevails in each house; provided that in no event shall either of the parties have less than one member from each house on the committee. Members may be removed from the committee by the legislative council, at the request of the committee chair, for nonattendance according to legislative council policy. Vacancies on the committee, however caused, may be filled by the legislative council, or the legislative council may reduce the size of the committee by not making replacement appointments and, in such case, need not readjust party representation. No action shall be taken by the committee if a majority of the total membership from either house on the committee rejects such action."

     Section 2. A new section of Chapter 2 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] ECONOMIC AND RURAL DEVELOPMENT COMMITTEE--DUTIES.--The economic and rural development committee shall conduct a continuing study of the programs, agencies, policies, issues and needs of the state relating to economic and rural development, including a study of the impact of rules and administrative procedures and a review and study of the statutes, constitutional provisions, regulations and court decisions governing such programs, agencies, policies, issues and needs. The committee shall make an annual report of its findings and recommendations and shall recommend any necessary legislation to each session of the legislature."

     Section 3. A new section of Chapter 2 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] ECONOMIC AND RURAL DEVELOPMENT COMMITTEE--SUBCOMMITTEES.--

          A. The "administrative procedures subcommittee" is created as a permanent subcommittee to be appointed by the chair from among the members and advisors of the economic and rural development committee to review and examine rules for their impact on economic and rural development and to evaluate the model Administrative Procedures Act for its impact on economic and rural development in New Mexico. Its membership shall be composed of at least one member from the senate and one member from the house of representatives, and at least one member of the minority party shall be a member of the subcommittee.

          B. Other subcommittees of the economic and rural development committee shall be created only by majority vote of all members appointed to the committee, with the prior approval of the New Mexico legislative council, and shall be composed of members as described in Subsection A of this section.

          C. All meetings and expenditures of a subcommittee, other than the administrative procedures subcommittee, shall be approved by the full committee in advance of such meeting or expenditure, and the approval shall be shown in the minutes of the committee."

     Section 4. A new section of Chapter 2 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] ECONOMIC AND RURAL DEVELOPMENT COMMITTEE--REPORT.--The economic and rural development committee shall make a report of its findings and recommendations for consideration to the New Mexico legislative council on or before December 15 preceding each legislative session."

     Section 5. A new section of Chapter 2 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] ECONOMIC AND RURAL DEVELOPMENT COMMITTEE--STAFF.--The staff for the economic and rural development committee shall be provided by the legislative council service."
