Your JUDICIARY COMMITTEE, to whom has been referred
SENATE BILL 463
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 2, line 24, after the first occurrence of "of", strike the remainder of the line.
2. On page 5, line 21, strike "a" and insert in lieu thereof:
"the human services department designated pursuant to Section 27-2-27 NMSA 1978 as the single state agency for the enforcement of child and spousal support obligations pursuant to Title IV D of the federal Social Security Act and any other".
3. On page 6, line 24, after the period, insert:
"The provisions of the New Mexico Uniform Parentage Act shall not be used to expand personal jurisdiction of the district court over nonresident persons in cases subject to the Uniform Interstate Family Support Act.".
4. On page 7, line 11, after "maternity", insert "insofar as possible".
5. On page 8, line 18, strike "relinquished" and insert in lieu thereof "extinguished by relinquishment and decree of adoption pursuant to the Children's Code".
6. On page 14, line 5, strike "or".
7. On page 14, between lines 5 and 6, insert the following new subsection:
"B. in the case of a signatory who was a minor at the time of acknowledgment, the later of:
(1) sixty days after the eighteenth birthday of the signatory; or
(2) sixty days after the effective date of the
acknowledgment or denial, as provided in Section 3-304 of the
New Mexico Uniform Parentage Act; or".
8. Reletter the succeeding subsection accordingly.
9. On page 14, line 20, after "bureau", insert "or two years after the eighteenth birthday of the signatory, whichever is later".
10. On page 20, between lines 4 and 5, insert the following new subsection:
"E. The retention of material used for genetic testing shall be governed by the provisions of Section 24-21-5 NMSA 1978.".
11. On page 23, line 3, after the comma, insert "upon notice and after an opportunity for a hearing, and".
12. On page 24, line 8, after "parentage", strike the remainder of the line and insert in lieu thereof "may be released only to the parties tested or their representatives, the support-enforcement agency and the court.".
13. On page 39, line 17, strike "registration" and insert in lieu thereof "certificate".
14. On page 43, line 6, strike "father-child" and insert in lieu thereof "parental".
15. On page 43, line 9, strike "father" and insert in lieu thereof "noncustodial parent".
16. On page 43, strike lines 12 through 16 in their entirety and insert in lieu thereof the following new subsection:
"B. The court shall order child support payments to be made in accordance with Section 40-4A-4.1 NMSA 1978.".
17. On page 43, line 22, after "support" insert ", except as otherwise specifically provided by the Uniform Interstate Family Support Act".
18. On page 45, line 2, strike "new".
19. On page 45, line 3, strike "new".
20. On page 45, line 7, strike "new" and after "certificate", insert "prepared pursuant to Subsection A of this section".
