AN ACT

RELATING TO STATE LANDS; REQUIRING THE COMMISSIONER OF PUBLIC LANDS TO DEVELOP AND USE A MANUAL PRESCRIBING A UNIFORM CLASSIFICATION OF ACCOUNTS AND A UNIFORM SYSTEM FOR BUDGETING, REPORTING AND RECORDKEEPING.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of Chapter 19, Article 1 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] SYSTEM OF ACCOUNTING, REPORTING AND RECORDKEEPING--MANUAL.--

          A. The commissioner of public lands, in consultation with the state auditor, shall compile a manual prescribing a uniform classification of accounts and a uniform system for budgeting, reporting and recordkeeping that includes:

                (1) the reporting of all appropriations received and expended;

                (2) all revenue received by the state from each lease or contract entered into by the commissioner; and

                (3) a system for keeping, locating and tracking all documents related to transactions involving state lands, including all sales, leases and trades of state lands and any interest in those lands, all assignments of state leases or contracts and, if issued by competitive bid or proposal, all bids received for any transaction involving state land.

          B. The uniform system for budgeting, reporting and recordkeeping shall require the submission of at least quarterly financial reports to the state auditor and the legislative finance committee.

          C. The manual shall be reproduced by the commissioner and filed as required by the State Rules Act. Upon the filing, the requirements set forth in the manual shall constitute rules of the commissioner and have the force of law. The commissioner shall review the manual annually. Sections of the manual may be revised or amended from time to time by the commissioner."

     Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2009.
