A RESOLUTION

PROPOSING AMENDMENTS TO THE HOUSE RULES TO AUTHORIZE AUDIO STREAMING OF HOUSE FLOOR PROCEEDINGS AND CERTAIN COMMITTEE PROCEEDINGS AS A PILOT PROJECT AND ALLOWING AUDIO OR VIDEO RECORDING AND STREAMING OF HOUSE COMMITTEE PROCEEDINGS WITH THE PERMISSION OF THE CHAIR.

 

     WHEREAS, the rules of the house of representatives may be amended by a two-thirds vote of all the members of the house or by a majority vote of the members of the house upon the recommendation of the rules and order of business committee;

     NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF NEW MEXICO that a new House Rule 9-5-7 be adopted to read:

"9-5-7    Photography, video or audio recording or transmission of committee proceedings may, upon request, be allowed with the permission of the chair."; and

     BE IT FURTHER RESOLVED that a new House Rule 9-5-8 be adopted to read:

"9-5-8    During any session of the forty-ninth legislature,

the legislative council service is authorized, in consultation with the speaker, majority floor leader, minority floor leader and appropriate committee chairs, to produce live audio streams of committee proceedings. Any such live audio stream shall be accessible through the legislature's web site in a manner befitting the house of representatives, including an appropriate user interface, and shall begin as soon as practicable after the chair has called the meeting to order and shall terminate as soon as practicable after the committee has recessed or adjourned or upon order of the chair. Any such live audio stream shall carry a notice to the effect that the stream is being produced for the benefit of the public and any political use is prohibited."; and

     BE IT FURTHER RESOLVED that House Rule 9-10 be amended to read:

"9-10     The principal duties of the [chairman] chair of a committee are:

(a) to call the committee together at such reasonable times and places as to enable the committee to properly perform its functions. All committee members will be notified of committee meetings;

(b) to preside over meetings of the committee, maintain order and decide all questions of order subject to appeal to a majority of the appointed committee and to ensure that the decorum of the committee is preserved while maximizing the public's ability to observe, report on and participate in a meeting;

(c) to supervise and direct the clerical and other employees of the committee, helping with the preparation of reports to submit to the committee and to require the committee to keep a record of the attendance of committee members at all committee meetings and to file such attendance record with the chief clerk on Friday of each week. Such record shall be a public record;

(d) to have custody of all papers referred to the committee and to transmit them to the chief clerk when the committee is through with them and endorse on each document what action has been taken on it, if any;

(e) to see that bills are discussed in order as they are referred to the committee, except when another order of business is agreed upon by a majority of the appointed committee;

(f) to arrange in cooperation with the coordinator for joint hearings with a similar committee of the senate upon arrival of the committee members and the proper senate committee; and

(g) in the absence of the sponsor of a measure, be prepared, or designate a committee member to be prepared, to explain the bill to the house."; and

     BE IT FURTHER RESOLVED that a new House Rule 23-8-1 be adopted to read:

"23-8-1   The legislative council service is authorized to

produce a live audio stream of the house floor proceedings that is accessible through the legislature's web site in a manner befitting the house of representatives, including an appropriate user interface. The stream shall begin as soon as practicable after the speaker has announced a quorum is present and shall terminate as soon as practicable after a motion to recess or adjourn has carried, or upon the order of the speaker. The stream shall carry a notice to the effect that the stream is being produced for the benefit of the public and any political use is prohibited.".
