A RESOLUTION

TO EXPEL ALL MEMBERS OF THE HOUSE OF REPRESENTATIVES IN OFFICE DURING THE FORTY-EIGHTH LEGISLATURE THAT PREVIOUS TO THE FIRST SESSION OF THE FORTY-NINTH LEGISLATURE HAD NOT PERMITTED THE USE OF A BOLO TIE ON THE FLOOR OF THE HOUSE OF REPRESENTATIVES.

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     WHEREAS, the senate has allowed the use of the bolo tie on the floor of the senate for many years; and

     WHEREAS, the house of representatives introduced House Bill 115 during the first session of the forty-eighth legislature and passed it by a vote of fifty-nine to zero, the senate subsequently passed the bill by a vote of thirty-four to zero and the governor signed the bill; and

     WHEREAS, despite the enactment of its own House Bill 115 as Laws 2007, Chapter 10, the house of representatives refused entry on its floor to anyone wearing a bolo tie; and

     WHEREAS, the house of representatives has the power to expel any of its members who are guilty of contempt or disorderly conduct, and certainly refusal to acknowledge and accept the bolo tie as appropriate attire on the floor of the house of representatives is contempt of the laws of the state of New Mexico and there is often some disorderly conduct in that chamber anyway;

     NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE OF NEW MEXICO that the members of the house of representatives of the forty-ninth legislature who were not members of the forty-eighth legislature expel those who were members of the forty-eighth legislature and order the New Mexico rangers to round up the members of the forty-eighth legislature that are not members of the forty-ninth legislature; and

     BE IT FURTHER RESOLVED that the expelled and rounded-up members be taken to the state line of the state of New Mexico and set free outside the state's boundaries.
