AN ACT

RELATING TO GAME AND FISH; ENACTING A NEW SECTION OF CHAPTER 17, ARTICLE 3 NMSA 1978 TO PROVIDE FOR SPECIAL MANAGEMENT AREAS ON THE SAN JUAN RIVER.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of Chapter 17, Article 3 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] SAN JUAN RIVER SPECIAL MANAGEMENT PERMIT.--

          A. The state game commission may designate by rule special management areas on the San Juan river, below Navajo dam, as trophy fisheries management areas. Any person angling in a trophy fisheries management area is required to purchase a San Juan river special management permit in addition to a valid fishing license and other required validations.

          B. San Juan river special management permits may be purchased from the department of game and fish or authorized license vendors for a fee of five dollars ($5.00) for New Mexico residents and ten dollars ($10.00) for nonresidents and shall be valid for the license year in which it was purchased. All funds derived from the sale of San Juan river special management permits shall be credited to the game protection fund to be used exclusively in the San Juan river trophy fisheries management area for habitat improvement, improving angler access, habitat and fishery studies, mitigating siltation, improving the quality of the fishery and other similar activities."

     Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2010.
