FOR THE LEGISLATIVE EDUCATION STUDY COMMITTEE

 

AN ACT

RELATING TO PUBLIC SCHOOLS; PROHIBITING VIRTUAL CHARTER SCHOOLS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Charter Schools Act is enacted to read:

     "[NEW MATERIAL] VIRTUAL CHARTER SCHOOLS PROHIBITED.--

          A. As used in this section, "virtual charter school" means an educational program that uses a proprietary curriculum and that is designed to deliver more than one-half of the program to the student electronically in the student's home or other site that is not a public school. "Virtual charter school" does not include the provision of on-line courses through the New Mexico cyber academy.

          B. Virtual charter schools are prohibited in New Mexico."
