FOR THE COURTS, CORRECTIONS AND JUSTICE COMMITTEE

 

AN ACT

RELATING TO LAW ENFORCEMENT; ESTABLISHING UNIFORM POLICE REPORTS FOR INCIDENTS OF DOMESTIC ABUSE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of Chapter 29 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] UNIFORM POLICE REPORTS--DOMESTIC ABUSE.--

          A. The department of public safety shall develop and, in consultation with law enforcement agencies statewide, periodically review and update a standard domestic abuse report form to be used by law enforcement officers when investigating or making an arrest for a violation of the Crimes Against Household Members Act, the Harassment and Stalking Act or a similar municipal or county ordinance.

          B. A law enforcement officer investigating or making an arrest for a violation of the Crimes Against Household Members Act, the Harassment and Stalking Act or a similar municipal or county ordinance shall use the standard domestic abuse report form developed by the department of public safety pursuant to Subsection A of this section."

     Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2010.
