Mr. Speaker:

    Your EDUCATION COMMITTEE, to whom has been referred

HOUSE BILL 73, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. Strike House Consumer and Public Affairs Committee Amendment 2.

     2. On page 1, line 12, after "AVAILABLE", insert "; DECLARING AN EMERGENCY".

     3. On page 3, lines 19 through 22, strike Subsection H in its entirety and insert in lieu thereof:

          "H. On or before June 1 of each year, the department shall allocate up to ninety percent of each school's allocation. On or before January 15 of each year, the department shall recompute each allocation using the first reporting date for that year and shall allocate the balance of the annual appropriation, adjusting for any overestimation or underestimation made in the first allocation."".

     4. On page 3, between lines 22 and 23, insert a new Section:

     "SECTION 2.--It is necessary for the public peace, health and safety that this act take effect immediately.".
