AN ACT

RELATING TO PROCUREMENT; REQUIRING EVALUATORS TO SIGN AND RETAIN EVALUATION DOCUMENTS AS PUBLIC RECORDS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 13 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] EVALUATION DOCUMENTS--SIGNATURES--PUBLIC RECORD.--

          A. Any documents used by a state agency or local public body to evaluate bids, formal requests for proposals or competitive sealed proposals for contracts over fifty thousand dollars ($50,000) issued pursuant to the Procurement Code or any other public works project shall be signed by the individual evaluators on the selection committee and retained for the length of the contract.

          B. The evaluation documents shall be maintained as a public record subject to the Inspection of Public Records Act."
